Your access to and use of the Study’s webpages is conditioned on your acceptance of and compliance with this privacy notice. These Terms apply to all Study subjects who access these webpages for the Study.
By accessing or using the Study webpages you agree to be bound by the privacy notice. If you disagree with any part of this privacy notice, then you may not access the Study webpages. If so, please discuss with your Study Doctor, so you may be provided alternative instructions on how to self-inject the Study Drug for this Study.
Termination
AI Software, Inc. may terminate or suspend access to the Study’s webpages immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the privacy notice.
All provisions of the privacy notice which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law
This privacy notice shall be governed and construed in accordance with the laws of Ohio, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of the privacy notice will not be considered a waiver of those rights. If any provision of the privacy notice is held to be invalid or unenforceable by a court, the remaining provisions of the privacy notice will remain in effect. The privacy notice is the entire agreement between us regarding this Study’s webpages.
Changes
AI Software, Inc. reserves the right, with permission from clinical research organisation Medpace and the Sponsor of the Study, NGM Biopharmaceuticals, Inc., to modify this privacy policy at any time. If a revision is material AI Software, Inc. will try to provide at least thirty (30) days’ notice prior to any new terms taking effect on this privacy policy. What constitutes a material change will be determined by the clinical research organisation Medpace and the Sponsor of the Study, NGM Biopharmaceuticals, Inc., to be in compliance with applicable laws.
By continuing to access or use the Study’s webpages after those revisions become effective, you will need to agree to be bound by the revised privacy policy, at that timeframe. If you do not agree to the new terms, you will no longer be able to access the Study’s webpages and you will need to contact your Study Doctor for alternate information on how to self-inject your Study Drug.
YOUR CALIFORNIA PRIVACY RIGHTS
Under the California Consumer Privacy Act of 2018 (CCPA), you have the right to know what personal information is being collected and whether your personal data is sold or disclosed and to whom, to decline the sale of personal data, to have access to your personal data, to request us to delete any personal information about you that we have collected from you. We will not discriminate against you for exercising your privacy rights. In addition, California Civil Code Section 1798.83 permits California residents to request certain information, once a year, regarding our disclosure of personal data to third-parties for their direct marketing purposes. To make such a request, please send us an email using the contact information provided below and put “Shine the Light Request” in the subject line of your email. Additionally, to exercise a request to know or a request to delete, you may complete the Request Under The California Consumer Privacy Act form or call our Patient Communications Center (PCC) at 844-627-5361.
When we receive a request, we will take steps to verify the identity of the requestor including, for example, by asking that the requester confirm or verify various pieces of personal data that we hold about them. You may also utilise an authorised agent that has been registered with the State and, if used, we will require evidence of authorisation from your agent as well.
For requests submitted by California residents, you may use an authorised agent registered by the California Secretary of State. Authorised agents must have written permission to submit requests on your behalf. Whenever feasible for verification, we will match the identifying information provided by you to the personal data already maintained by us. If, however, we cannot verify your identity from the information already maintained by us, we may request additional information.
You also have the right to lodge a complaint with the local data protection authority if you believe that we have not complied with applicable data protection laws.
